GENERAL TERMS AND CONDITIONS OF USE OF THE “FITPRIME PLATFORM”

1. Terms and Conditions of use

1.1. These General Terms and Conditions of Use (hereinafter also “T&C”) of the Fitprime Platform have as their object the use and access to the Site webplaces.fitprime.com/therapy.fitprime.com/smart.fitprime.com/nutrition.fitprime.comand the Fitprime application (formerly CheckMoov, hereinafter also the App), which are managed and provided by CheckMoov S.r.l. (hereinafter also the Company), with registered office in (00161) Rome, Viale di Villa Massimo n. 39, VAT number 13755581009.

1.1.1 In the event that the user requests one of the Services offered by the Company via access the “welfare.fitprime.com” website using your Welfare Credit, you must check the Conditions of use indicated by the relevant welfare provider.

1.2. By browsing or accessing the Website and the Fitprime App (hereinafter also the PlatformorService), you agree to be bound by these General Terms and Conditions of Use of the Platform.

1.3. Failure to comply with the provisions of article 3 (Registration) and, in general, of everything provided in these Terms and Conditions General Terms of Use of the “Fitprime Platform” constitutes a serious breach and may lead, depending on the case, to the use by Fitprime of one or more measures between those indicated below:

  • immediate injunction, temporarily or permanently, of the right to access the Service;
  • immediate removal, temporarily or permanently, of the user’s account;
  • sending a reminder to the user;
  • judicial action against the User, including the request for reimbursement of all costs (including, but not limited to, reasonable administrative and legal costs) deriving from the violation of the art. 3;

Fitprime, following a failure to comply with the T&Cs, deciding to inhibit or temporarily or permanently remove the user’s account, will not effect any kind of reimbursement, nor of the plan active at the time of closing the account, nor of any residual credit obtained during use of the service.


2. Object

  • 2.1. The Company, through the Website and the App, promotes to those who access and use the Platform (hereinafter also the Customers or Users) and the services offered by the Sports Centers that are part of the same (hereinafter the Centres or Sport centers).
  • 2.2. The Company, through the so-called geolocation of the Center Sportivo, allows Customers to book and purchase daily tickets or packages of entries to the Sports Centers and/or the Fitprime Monthly Subscription Offer with the App and website intermediation service.

  • 2.3. The Website and App were designed to incentivize the use of innovative and high-tech services provided by the Company, which also have as their object assistance and support to other companies and/or people physical for the supply of:

  • to. services aimed at optimizing the supply and demand processes of type activities sports and psychophysical well-being through innovative technologies via website/App;
  • b. remote booking and marketing services by any means electronic communication;
  • c. any further research and development activities with the aim of improving the sectors related to fitness and well-being;
  • d. services aimed at allowing anyone to carry out physical activity even from home, or without a gym membership anyway;
  • And. services to encourage correct nutrition through the receipt of plans nutritional.

3. Registering for Fitprime

  • 3.1. The User can access the application on the App and on the Website by using your Facebook, Google or Apple account or by providing the requested data by the Company (name, surname, telephone number, e-mail address, password, Fiscal Code).
    To register with Fitprime you must be at least 16 years old.

  • 3.2. The creation of multiple accounts by the single User, who may therefore be the owner of a single account Fitprime. In any case, the application cannot be used in an evasive manner with respect to the provisions of this regulation and/or the law.

  • 3.3. By registering, the User declares and guarantees that all personal data information provided is current, complete, accurate and truthful and undertakes to promptly communicate to the Company any changes relating to such personal data.

  • 3.4. The User authorizes the Company to verify, at any time, the correctness of the personal data and any other information provided and undertakes to collaborate with the Company during such checks. Furthermore, the company reserves the right to request additional documents from the User in order to verify the correctness and truthfulness of the registration data.

  • 3.5. The User undertakes not to disseminate the information regarding your account or make them accessible to third parties.

  • 3.6. The User declares to be solely responsible for the possession and of the use of login credentials. If you become aware of any unauthorized use authorized of your credentials and/or other violations of their confidentiality, yes undertakes to promptly inform the Company of such unauthorized use and/or violation, reporting any abuse to the following email address:info@fitprime.com.

  • 3.7. In the event that the Company has a well-founded fear that the data of registration have been falsified and/or that the application is used in a manner elusive with respect to the provisions of this regulation and/or the law, the Company itself reserves the right to suspend or remove the User’s account, without payment of any compensation or refund.

  • 3.8. In particular, if the Company ascertains the creation, by of the User, of multiple accounts and/or in any case of use of the Application in elusive manner with respect to the provisions of this regulation and/or the rules of law, the automatic application of a sanction corresponding to the withdrawal is foreseen automatic on the payment method entered by the User at the time of registration (credit/debit or prepaid card) known to the Company, in the amount of Euro 50.00, as a penalty for failure to comply with the Terms and Conditions of Use of Fitprime platform.

  • 3.9. The User declares to use the services provided by the Company for your exclusive benefit only. Fitprime services and any content displayed through the service, are intended exclusively for personal and non-personal use commercial and cannot be shared with third parties. During its validity of the subscription, the User will have a limited, non-exclusive and non-transferable right to access the service and view the contents.


4. User cancellation

  • 4.1. Users have the possibility to unsubscribe from the Platform simply by sending an email to info@fitprime.com, clearly expressing your wish to unsubscribe from the Platform.

  • 4.2. Once you have canceled your registration on the Platform, also subsequently of cancellation, the User will lose any credit, bonus or discount.


5. Purchase of daily admissions and/or Unlimited monthly or quarterly subscription

  • 5.1. The User, once registered on the App and on the Website, will be able to view the Sports Centers that are part of the Fitprime Platform and the services from the latter offered, including the possible free first entry daily.

  • 5.2. The User, through the so-called geolocation of the Center, you will be able to choose the Center where you wish to train and find out the relevant methods access, i.e. whether to purchase only a daily entry, entry packages or a monthly subscription at the cost shown on the specific Center screen, by choosing a subscription plan compatible with the Center, among the plans proposed in the subsection “Prices” or “Profile > Subscriptions” of the Site or App. In the third case the User will have the opportunity to go to all the Sports Centers of the company during the month Platform a maximum of once a day.

  • 5.3. The User to purchase the daily entrance or season ticket monthly you will have to follow the instructions that appear on the screen and carry out the payments as specified in paragraph 7.

  • 5.4. The User may simultaneously activate an Unlimited Plan and Entry Packages, which can be managed independently from your Profile, under Subscriptions. The User who has two active plans will therefore be able to make two check-in on the same day (one allowed for Unlimited and one for Packages Entrances).

  • 5.5. The User who has subscribed to an Unlimited subscription plan, will have the possibility to increase the price range of the current plan, upon payment of the difference between the floors. The User will be able to independently carry out the modification of the plan by pressing on the “Upgrade” item of the center of interest not included, both in case of active renewal, and deactivated in the case of renewal. From the moment of the Upgrade, the User will be able to access the new centers included in the selected price range, up to plan expiration date. In case of active automatic renewal, the plan subject to Upgrade will be renewed at the new price range selected by the User.


6. Verification of the unique code

  • 6.1. The Customer who purchases and books a service from the App or Website offered by the Sports Center (one entry) will receive a unique code (hereinafter also the Check-in Code) from Fitprime, which you can view directly from the site in the “Profile”, under “Reservations” or from the App, in the “Reservations” tab. For To automatically check in, simply press Checkin and show the screen confirmation at reception. In case the automatic check-in does not go to If successful, the User will be able to check in manually by communicating the confirmation code present on the check-in screen. The User’s access to center will be permitted subject to check-in verification and authorization by the Reception.

  • 6.2. The Customer must communicate to the Center at the time of check-in Sportsman the unique valid code.

  • 6.3. Where the unique code is not used on the date selected, it can no longer be used at the Sports Center.

  • 6.4. The Center may, where it deems it appropriate, request to the User a valid identity document at the time of automatic or manual check-in.

  • 6.5. The User who has activated an unlimited plan or packages Entrances, you can only check-in once per day at a Sports Center selected. In the case of multiple subscriptions (simultaneous activation of packages Entrances and Unlimited), the User will be able to carry out two Check-ins. The User will use therefore also an entry from the Packages floor.


7. Payment conditions for daily admissions and/or unlimited subscriptions

  • 7.1. The User, once the requested data has been entered, accepts i terms and conditions of use and privacy policy, selected the Center and the access method, you must make payment via credit, debit or card prepaid (Payment Method), based on the access methods requested (Entrances daily, Unlimited Pass or Entry Packages).
    The User will be responsible for any outstanding amounts. If a charge does not was successful due to expiry of Payment Method, insufficient funds or for any other reason, and if the User has not deleted theirs account, the Company reserves the right to suspend access to the service by of the user until a valid Payment Method is successfully entered.

  • 7.2. The User must pay the Company via credit card, of debit or prepaid the amount corresponding to the daily entry and/or season ticket unlimited booked and purchased.

  • 7.3.The single daily entry can be used by the User only on the same day of purchase and there is no possibility of refund case of non-use.

  • 7.4. The Unlimited monthly payment is valid for one calendar month from the moment of the purchase (example: if purchased on January 15th it will be valid until February 15th, if purchased on January 31st it will be valid until February 28th)

  • 7.5. The 5-entry package is valid for one calendar month while the package of 10 entries lasts 2 calendar months from the time of purchase (as well as indicated in point 7.4.)

  • 7.6. The Unlimited quarterly, provided only to the User who uses the Fitprime Biz Platform and is valid for three calendar months from the moment of the purchase.

  • 7.7. In some cases the payment date may vary, for example in in the event that the charge to the User’s Payment Method is unsuccessful, if the subscription plan is changed or the paid subscription has began on a day not present in a given month.

  • 7.8. Fitprime may change the price of any from time to time Subscription, whether Unlimited Subscription or entry packages, and will communicate in advance such changes if there is an increase in the payment due by you. Under of applicable law, you accept the new price by not canceling your Subscription after the price change comes into force. If the user does not agree with a change in price, you have the right to refuse the change by unsubscribing from Services before the price change comes into effect.


8. Automatic Renewal

  • 8.1. All Fitprime plans are subject to automatic renewal. At the expiration of the subscription signed on the Platform, unless deactivated of the recurrence option, your subscription will automatically renew

  • 8.2. The User may deactivate the automatic renewal option by logging in with your ID (registration email and password, or via Facebook account, Google and Apple) from the site or app. The User will find the option to deactivate the automatic renewal in the Profile section> Active Subscriptions> Cancel Renewal. The automatic renewal can be deactivated independently and at any time within 3 days before the renewal date.

  • 8.3. If the automatic renewal option is deactivated, the User will still be able to continue to use his subscription for the remaining days, therefore until the deadline indicated under Active Subscriptions. Upon expiration, the plan chosen will no longer be active and will not renew automatically.

  • 8.4. The User accepts the terms and conditions of the service in the App/Site Web, including the Renewal option in case of purchase (at the end of which a popover indicating the exact Renewal date in case of failure to deactivate the same).

  • 8.5. The Limited 5 and 10 entry package plans are renewed, as follows like the Unlimited plan, on the same day as the plan expires, therefore providing 5 or 10 entries. Therefore, when using the plan on the same day as it expires the user will see the new entrances of the newly renovated floor deducted, and not the entrances unused and expired on the same day.

  • 8.6. The Limited 5 and 10 entry package plans are renewed, as follows like the Unlimited plan, on the same day as the plan expires, therefore providing 5 or 10 entries. Therefore, when using the plan on the same day as it expires the user will see the new entrances of the newly renovated floor deducted, and not the entrances unused and expired on the same day.

  • 8.7. Based on the provisions of point 8.3. it is therefore not possible request a refund after the renewal has already taken place. In this case, the User you can cancel the auto-renewal for the following month no later than 3 days before of the expiration of the subscribed subscription. After the cancellation of the renewal his plan will however remain active until the expiry date indicated in the Profile, under the heading ”Active Subscriptions”.

  • 8.8. The User has the right to withdraw from all Fitprime plans by 14 days from purchase, without indication of any reason and without forecast of costs additional, pursuant to the Consumer Code (Legislative Decree no. 206/2005).
    The Company will refund the User the full payment, if made, subject to that the User has not entered any Sports Center within the aforementioned periods 14 days.
    In order to be able to exercise the right of withdrawal within the contractual deadline provided, the User must send the communication to the email address info@fitprime.com of withdrawal, before this deadline has expired.
    In consideration of this short duration of the contracts in question, the User waives make use of the right of withdrawal pursuant to the Consumer Code, within 14 days from the stipulation, if the User has already benefited, at least once, from the Fitprime service.


9. I use referral code

The referral/friend code is your personal code that the User can share with friends. This code allows you to accumulate up to €25 credit on Fitprime for each friend you make sign up with their referral/friend code, providing them with a €25 discount on the first one purchase.

Limitations and conditions

By inviting a friend of yours you will earn:

  • - €25 in case of active plan with active renewal

  • - €10 in case of active plan with deactivated renewal

  • - €25 if no plan has ever been activated

  • - €10 in case of an active plan in the past

The invited person will always receive €25 credit on Fitprime Sports Subscriptions which they will be automatically deducted during the purchase phase, upon correct use of the Code referral/Friend.

The User who has earned €25 with an active plan with renewal which, subsequently, deactivate the renewal and you will lose the credit. The maximum cumulative credit is €250 and/or however, it cannot exceed the value of 10 invitations. Upon reaching the maximum credit Invited users will continue to receive €25 for signing up but the inviting user will not will accumulate further credit.

Your code can only be shared and not used on your account for purchasing the plan.

Credits resulting from the use of the referral code are subject to the General Conditions referred to in the art. 1 of the same Terms and Conditions of use.


10. Geolocation

  • 10.1. The Company, subject to the User’s consent, may use the data relating to localizations, in order to geolocate your computer or device mobile of the User.

  • 10.2. Location data will be requested and used by the Company for the sole purpose of promoting the Sports Centers to Users close to them and the services offered by them.


11. User Responsibilities

  • 11.1. The User undertakes to diligently and carefully comply with the these conditions and terms of use.

  • 11.2. The User must access and use the Fitprime platform only and exclusively for lawful purposes, in compliance with current legislation, both national and international.

  • 11.3. Once the user has purchased the plan, he accepts any e possible updates (increase/decrease) of the prices of your tariff plan. These updates are in fact related to consequent changes in the prices of the products themselves centers, during the collaboration with Fitprime.

  • 11.4. The User must not disseminate, through the App and the Website, illicit, defamatory or harmful content, nor use the App and the Website in a damaging manner the image and reputation of the Company or causing any other damage or loss to the Company, nor prevent the use of the App by others Users. If the User does not comply with these obligations, he will be liable for any losses and any resulting damage.

  • 11.5. The User, in using the service provided by the Centre A sportsman, he must respect the rules of the same. In case of violation of the rules of sports centre, Fitprime reserves the right to suspend the subscription.

  • 11.6. The User must inform the Company of the abuses and/or violations of these conditions and terms of use, by sending a specific report to the email address info@fitprime.com. The Company will verify the reliability of the reporting and will take the necessary measures.


12. Disclaimer of Company

  • 12.1. The Company undertakes to ensure that the App and the Website contain correct and/or updated information. However, the Company cannot be held liable responsible for the accuracy or completeness of the content published on the App and on Website, without prejudice to its liability for willful misconduct and gross negligence and in other cases provided for by law.

  • 12.2. The Company will not be held responsible for the correctness, the accuracy and truthfulness of the information provided by Users.

  • 12.3. The Company will not be held responsible for the use of the application and its contents by the Users.

  • 12.4. The Company will not be held responsible for any discrepancies and/or inaccuracies in the information provided by the Sports Centres.

  • 12.5. The Company does not guarantee that the App and the Website will function in continuously, without interruptions and errors also due to access to the network or to any other reason beyond its control.

  • 12.6. The Company is not liable for any resulting damages from inaccessibility to the services provided on the App or resulting from errors, omissions, interruption of service, deletion of content, connection problems network, service provider or telephone line, unauthorized access, data alteration, failures of users’ electronic devices.

  • 12.7. The Company is exempt from any type of responsibility for links which, through the Platform, allow access to services provided by third parties, which are in no way connected to the Company (the Third Party Sites). The society, in fact, it does not control or monitor such Third Party Sites or their contents.


13. Statements by the User

  • 13.1. The User, once purchased the Fitprime service, booked the his entry to the Sports Center and having checked in there, he declares and guarantees that he has carried out the necessary medical checks and that he is in good health physical conditions, that they have not taken and have not taken in the previous 48 hours narcotic and/or psychotropic substances, not to have exceeded the consumption of drinks alcohol and food, that you are not under the influence of drugs and that you can carry out your activities selected activities at the Sports Center, without prejudice to the rights of the Center itself Sportsman to be able to request medical certification in this regard.

  • 13.2. The User, declaring his suitability to participate in the sporting activities, exempts the Company from any liability regarding any health problems that may arise and/or accidents, pathologies and any other damage resulting from carrying out non-compliant activities at the facilities their physical and health conditions.

  • 13.3. The User therefore declares his own and exclusive rights responsibility regarding one’s state of health and to comply with any certified medical restrictions with reference to your participation in the activities carried out at the Sports Centres. The User also declares to have been informed of the risks and dangers associated with the use of the services provided by the Centre sportsman and to knowingly assume all risks relating to any loss or/and damage to personal property as well as any personal injury to the User and/or of third parties that may arise from the use of the Sports Centre’s services, whether such risk is known or unknown to the User.

  • 13.4. The User declares to exempt the Company from liability for any damage caused to your person and/or to third parties following use of equipment of any type present within the Sports Centres. The User also declares to have been informed of the associated risks and dangers to use the equipment present within the Sports Center and to assume responsibility knowingly all risks relating to any damage caused to one’s person and/or to third parties that may arise from the use of such equipment, whether such risk is known or unknown to the User.


14. Fitprime Smart

Fitprime Smart is a paid home-workout platform. The same is accessible for the User via the website.

  • 14.1. Definition of User and Trainer. By User we mean the person who registers on the Fitprime Smart platform in order to be able to view and participate in on-demand workouts/live lessons. The Trainer, on the other hand, is the person who uses the Platform for training activities, or to provide the User with information workouts, training directions and other information and services.

  • 15.Fitprime Smart Subscription

    • 15.1 The Fitprime Smart platform is paid, except for the period 14 day free trial. The free trial period offers the plan for 14 days, after choosing the monthly or annual subscription plan, and therefore the possibility of the User to use the platform both for viewing of on-demand workouts and for participation in LIVE lessons. The user you will only be able to use the free trial period once. Fitprime Smart delivers different subscription periods to allow the User to choose what best meets her needs. The different types of Subscription and prices are available on the platform. Fitprime reserves the right to make changes to prices based on your commercial needs and changes to services included in the subscriptions themselves. Any price changes will be communicated to the user before any charge.

    • 15.2 The duration of the subscription, the price and its content are illustrated on the platform at the time of purchase and in the menu item Subscriptions. The User will finalize the contract by clicking on the Finish and pay.

    • 15.3 Subscriptions are available for valid periods minimum minimum and are automatically renewed for the same selected period if the user does not cancel the subscription within the day prior to the expiry date.

  • 15.2.Automatic renewal

    • 15.2.1 The Subscription renews automatically accordingly the amount due is charged in advance at the beginning of the respective period of renewal.

    • 15.2.2 Upon expiration of the Subscription period, on the method of The User’s default payment will be automatically charged the price of the Subscription selected when subscribing to it, e the Subscription will be renewed for the same period of time, unless the User you do not cancel the renewal within the day before the date of expiration. .

    • 15.2.3 You can cancel your Subscription at any time, by the day before the expiry date, directly from the Profile, to “Subscription” item. The Subscription will remain active for the period already paid for and therefore until the scheduled renewal date.

  • 15.3. Cancellation of renewal

    • 15.3.1 The User has the right to withdraw from the contract, without indication of any reason and without provision of additional costs, pursuant to Consumer Code (Legislative Decree no. 206/2005). The Company will refund the User in full payment, if made, provided that the User has not used the platform in the 14 days following the first purchase. In order to be able to exercise the right of withdrawal within the contractually established deadline, the User must send to email address info@fitprime.com the notice of withdrawal, before this deadline has expired.

  • 15.4. Behavioral rules for Live lessons

    • 15.4.1 The user is required to correctly observe the opening times reservations for Live Lessons. You are allowed to access a Live lesson by maximum 10 minutes from the start of the session. Following this period of time maximum, Fitprime reserves the right to exclude the user from access.

    • 15.4.2 Behavioral or uncivil shortcomings are not accepted during lessons. Therefore Fitprime reserves the right, upon notification from the Trainer, to reference, the right to block the subscription to the user who takes on a inappropriate behavior, even following warning from the Trainer and Fitprime itself.

    • 15.4.3 To book live lessons the user must have purchased the suitable subscription and followed the booking process on Fitprime Smart or be in the 14-day free trial of the service.

    • 15.4.4 It is not possible to share your reservation and the login credentials for a Live chat with another person. The reservation is personal, and therefore belongs to the user in possession of the Fitprime subscription or of the free trial that carried out the same. It is therefore not shareable either transferable to third parties.

    • 15.4.5 The reservation, in case of non-participation, is valid always cancelled, no later than 30 minutes before the start of the lesson.

    • 15.4.6 If the reservation is cancelled, it is possible to book again for the same lesson only if there are still free places. In under no circumstances will having previously booked the same classNamee confer the possibility of having guaranteed access.

  • 15.5 Fitprime Smart Service

    • 15.5.1 You agree not to store, reproduce, distribute, modify, display, publish, license, create derivative works from, offer for sale or use (except where expressly authorized in the these Terms of Use) contents and information on the Fitprime Smart service or obtained from or through the Fitprime Smart service. The User also agrees not to: circumvent, remove, alter, deactivate, degrade or block the protections of contained in the Fitprime Smart service; use robots, spiders, scrapers or others automatic tools to access the Fitprime Smart service; decompile, submit to reverse engineer or disassemble any software or other product or process accessible via the Fitprime Smart service; enter any code or product or manipulate the content of the Fitprime Smart service in any way; or use any data mining or data gathering or extraction methods. The User accepts not to upload, post, email or otherwise send or transmit any material designed to interrupt, destroy or restrict functionality of any computer software or hardware or terminal of telecommunications associated with the Fitprime Smart service, including viruses and any other computer code, file, or program. The Company reserves the right to limit or interrupt the use of the service towards the User, in case of violation of these T&Cs or you use the service in an illicit manner or fraudulent.

    • 15.5.2 The quality of display of Fitprime Smart content may vary depending on the device and may be affected by a series of factors, such as your geographic location, available bandwidth or speed of your Internet connection.

    15.6 Disclaimer of Company Liability

    • 15.6.1 The preliminary condition for using the platform Fitprime Smart is a general condition of good health. If the user is aware of any pre-existing medical problem, we suggest checking with a doctor before starting to use the service. Or if the User is aware of one or more disorders/conditions such as: cardiovascular diseases; pathologies pulmonary or respiratory; spine and/or joint problems; neuromuscular pathologies; surgical procedures; any other health problem. If you have any doubts about your health you should consult your doctor before starting or continue using Fitprime Smart.

    • 15.6.2 By accepting these Terms and Conditions, the User confirms that he is in good health and responsible for his physical condition, respecting any certified medical restrictions with reference to your own participation in sporting activity.

    • 15.6.3 It is not implied or guaranteed that use of the platform Fitprime leads to the physical or other results desired by the User. THE Actual results of workouts depend on factors that may not be influenced, such as physical predisposition and pre-existing conditions. THE results may therefore differ significantly between different people despite the common use of the platform.

    • 15.6.4 If the User uses sports equipment or instruments, it is It is your responsibility to ensure that such equipment and tools are in good condition operating and installation conditions and/or are correctly set during carrying out physical activity with Fitprime Smart.

    • 15.6.5 In light of the type of service offered (which is limited to the provision of digital content and the management of some data personal) Fitprime declines all responsibility for possible damages that the User may encounter while using the service.

    • 15.6.6 The Company is released from any related liability to the presence of a minor in classNamei LIVE and during the use of contents on demand, as it concerns the same legal guardian of the person underage. The guardian therefore gives full consent to the possible dissemination of audio and photographic, or other audiovisual materials containing the image (also in foreground), the name, the voice, during the carrying out of the activities organized by Checkmoov Srl on Fitprime Smart or any future channels used exclusively to document and disseminate activities relating to the Fitprime Smart platform, relating to the minor. This permission does not allow use of the image in contexts that compromise the personal dignity and decorum of the minor and in any case for use and/or purposes other than those indicated above, therefore the same will be responsible guardian/guardian. Furthermore, the owner will process personal data for as long as necessary to fulfill the above purposes. The guardian relieves those responsible of the event and the Company from any liability inherent to incorrect use of images and audiovisual content, as follows: Legislation in force regarding the right to privacy and the publication of material video/photographic (web included). Privacy Code 196/2003 and provisions consequent Legislative Decree 10 August 2018, n. 101 and the prevailing GDPR 679/16.     16. Fitprime Therapy

    • Fitprime Therapy: psychological consultancy service offered by psychologists and psychotherapists (hereinafter: the “Psychologists”) on behalf of the Company to its Users, to allow them to improve their psychological health.
    • 16.1 The Fitprime Therapy service is available only to Users register on the Website and can be accessed in the Services > section Therapy. Service Fitprime Therapy will be provided exclusively remotely and via Google Meet platform.

    • 16.2 The User to use the Fitprime Therapy service, at the moment of booking the first interview, as indicated in the following article 20.3, will have to complete an information questionnaire.

    • 16.3 The Fitprime Therapy service allows the User to fix with a Psychologist, an initial free interview lasting 20 minutes.

    • 16.4 The User, following the aforementioned cognitive interview, you will be able to book a psychological support session lasting 50 minutes directly on the Fitprime calendar via the Therapy voucher.

    • 16.5 If the User does not have a Therapy voucher you can purchase it when booking the session according to the rates indicated in the appropriate section.


    17. Fitprime Nutrition

    • 17.1 Fitprime Nutrition offers meal plans, which do not come in in no case considered medical advice or diagnosis. The consumption of Recommended foods may not be advisable for some individuals, depending their state of health (particularly for those who are not in good physical shape, for those with health problems, for pregnant or breastfeeding women, or for those who need a specific diet, etc.)

    • 17.2 Before using the services offered by the Company, the User you should consult a doctor or healthcare professional.

    • 17.3 In case of use, the User guarantees and declares as much follows:

      • - to be in good health and in a suitable physical condition our food plans;

      • - that the information provided through the online medical history is truthful and precise;

      • - that you do not suffer from heart or joint pathologies or health problems hypertension, obesity, cholesterol, diabetes, nor are you familiar with any pathologies of this type;

      • - that you have not received any contrary opinion from your doctor about one or more dietary regimes, in relation to one’s health conditions;

      • - that I have no reason to believe, for any reason, that I should not follow the Fitprime Nutrition meal plans.

    • 17.4 The user is informed and acknowledges that Fitprime’s services Nutrition are offered in the form of digital services and content, and that the execution of the contract begins at the moment of payment for the meal plan.


    18. Privacy Policy

    • The Company is authorized to process personal data exclusively for the purposes of registration on the Fitprime Platform of the advertising of the services offered by the Company, of the geolocation of the Sports Centers, of the reservation and of the purchase of daily admissions and/or monthly passes and/or travel packages Fitprime entry through the intermediation service of the App and the Website. I collected data may also be used to send commercial communications and direct sales promotions via SMS or email, market research on products and services.     19. Intellectual property rights

    • 19.1. All contents of the App and the Website are protected by copyright and other intellectual and industrial property rights of Company or its third party owner. Reproduction, in whole or in part, in any form, of the application and its contents is not permitted without the written permission of the Company.
    • 19.2. The User, during the search for the Sports Center and the booking entry, use the software made available by the Company through the application pursuant to a non-exclusive and temporary license granted for the time strictly necessary to carry out the relevant operation.
    • 19.3. All signs relating to the Company and the Fitprime service Gyms, Fitprime Smart, Fitprime Nutrition or Fitprime Biz (logo, brand and any other sign that includes any terms relating to the Company and Fitprime) not can be used by users.
    • 19.4. All other signs used to distinguish the Centers Sportsmen and the services offered by them on the App are registered trademarks of ownership of their respective owners and are used on the App for the sole purpose of distinguishing, describe and promote the Fitprime Sports Centers Services on the application. Any illegitimate or unauthorized use of these trademarks is prohibited.
    • 19.5. The User is not authorized to modify and/or copy the App or Sites Web, nor can it extract the source code of the App or Websites, translate the App or Company Websites and its contents in other languages or create derivative versions thereof.

    20. Changes and updates to the General Terms and Conditions of Use of Platform

    • 20.1. The Company reserves the right to modify or simply update, in whole or in part, the General Terms and Conditions of Use of Platform.
    • 20.2. Any modification or update to the Terms and Conditions General Terms of Use of the Platform becomes binding from the moment it is published on the App or on the Website.

    21. Applicable law and competent court

    • 21.1. These General Terms and Conditions of Use of Fitprime platform are subject to Italian law. Any dispute, controversy or claim arising out of, or relating to, these General Terms and Conditions of the Platform, or their violation, termination or validity will be devolved to exclusive jurisdiction of the Court of Rome.


    22. Novative effect

    • 22.1. These General Terms and Conditions of Use of Fitprime Platform cancel and replace, for all legal and legal purposes contract, the general terms and conditions of use of the platform previously provided and accepted by the Users.
